Terms and Conditions of Sale

The following terms and conditions (“T & C") apply to the purchase of products and services ("product") from VSV Ventures Pvt. Ltd. through this website, www.eveessentials.in,  ("website"), which are essential to the business. Purchaser shall mean the person who has purchased the products . By clicking "I Agree", you acknowledge that you have read, accepted and agreed to be bound by these T & C. You also agree that you are also subject to firm's terms of use and Privacy Policy, and the terms of any purchase order, quotation or invoice, and of any product purchased by or licensed to you and their Returns Policy. These T & C are subject to modification by firm without prior written notice at any time, in firm's sole discretion and that version of T & C will be applicable to the purchase as available on the day of order to firm.

Orders

All orders placed by you are subject to acceptance and availability, and items in your shopping basket are not reserved and may be purchased by other customers.

Firm offers products for sale that are in stock and available for dispatch from our distribution centre. For unforeseen and unavoidable circumstances, products may not be immediately available and you may choose to register your email address for notification of arrival of the selected merchandise not held in stock and the firm will endeavour to inform you at the earliest.

The Firm will store a record of your transactions / data in terms of the privacy policy. Once you place an order you will receive a confirmation email which is just a confirmation that we have received it. However such placing of order or registration of email does not qualify as ‘acceptance of order’ or a right of pre-emption.

The acceptance of your order and completion of the contract between you and firm will be completed only when we email you to confirm that the goods have been dispatched. Neither our third party payment processor nor our nominated courier has the authority to accept an order on behalf of firm. The firm reserves the right not to accept or reject your order or may refuse to process the same or suspend the transaction at any time and for any reason whatsoever at its sole discretion and the firm will not be liable for the same.

For reasons unknown and unforeseen circumstances, at times there might be an error in pricing of a product at the time placement of order and the firm shall be under no obligation to accept or fulfil such an order at an incorrect price and reserve the right to cancel such an order that has been accepted or is in transit and the same shall be informed to you by email or telephone about the non acceptance or cancellation of your order.

Price of the products or offers on products are liable to change from time to time at the firm’s sole discretion. Separate charges for taxes applicable as per government laws will be shown on the order invoice. Multiple payment options will be offered on the website from time to time such as UPI, credit and debit cards, internet banking etc. You confirm that the credentials you use for making the payment such as credit/debit card are yours or that you have been specifically authorised by the owner of the credit/debit cards to use them. If the issuer of your payment card refuses to authorise payment to firm, we will not be liable for any delay or non-delivery.

Shipping

Firm aims to dispatch your order within 24 to 48 hours after receiving your order. Once your order is dispatched, it may take around 2 to 6 working days for delivery depending on your location.

All orders are scheduled to arrive on or before the expected delivery date shown in the order confirmation. You will receive an email confirmation once your order ships. Firm is not liable for any delivery delays or failure to ship by the estimated due date, including without limitation as a result of events beyond firm's or its shippers' reasonable control and unforeseen circumstances, including without limitation shortage of materials, transportation failure, or acts of God. Firm may inform you of estimated delivery dates in case there is a delay in your delivery.

In case of non-delivery of your order within 10 days, please inform us so that we can resolve the issue. Any complaint after 10 days won't be entertained. The product will be delivered at the address mentioned by you at the time of placing order. Firm will not redirect your order once it has been dispatched. Presently, we do not offer international shipping. Also firm does not allow for delivery of products to a P.O. box address.

Limited warranty and disclaimers

The product being offered by the firm are of personal nature and use. The firm does not offer any warranty on the product except for defects in product being limited replacement as setforth in this section. No oral or written information, photographs, advertisements or advice given by firm, its agents or employees will create a representation, warranty or condition or in any way increase the scope of provision.

Firm will not be liable for lost profits, loss of business, lost data or direct, indirect, consequential, special or punitive damages, even if advised of the possibility of such damages, or for any claim by any third party. In any case, firm is not liable or responsible for any amount of damages above the aggregate amount paid by you for the purchase or supply of the product giving rise to the liability.

Returns, refund and cancellation

The products being of and for personal usage and nature of products, we do not accept returns or exchanges to maintain high hygiene standards, unless the product delivered is damaged or defective.

You may send us an email at connect@eveessentials.in with the details of damaged or defective product received from us alongwith a picture of the damage and seek refund or replacement. After verifying the damage, we will replace the product in about 10 business days. The replacement request for damaged goods should be sent to us within 24 hours of receiving the order.

In case your order is placed by mistake or you wish to cancel your order, please send an email to connect@eveessentials.in within 24 hours of placing the order. We will send you an email confirming the cancellation of your order in 24 to 48 business hours and thereafter within next 6 to 8 working days of the cancellation confirmation, the money will be refunded as per the payment mode. However orders already shipped from our side cannot be cancelled. Returns are not accepted for items purchased at a discounted amount. To complete your request, we require a receipt or proof of purchase.

In case of your request for refund of a defective or damaged product, we will also notify you of the approval or rejection of your refund. If approved, then your refund will be processed, and a credit will automatically be applied to your original method of payment, within 5-7 business days. Refunds are not processed for items purchased at a discounted amount. Late or missing refunds may happen due to the long process involved and you may first recheck with your bank or credit card firm and thereafter you may again contact us at connect@eveessentials.in. We only replace only defective or damaged products and exchange it for the same item.

Product changes

Products may change or be discontinued at any time. Firm will deliver products that have similar characteristics of the products you ordered, but minor changes between what is delivered and what is described online are possible. Products may differ slightly from depictions in any representations, illustrations, photography or descriptions on this website.

Governing law, disputes and language

The sale contract is concluded in India and the language of the contract is English. These T & C and all related matters will be governed by, and construed in accordance with, the laws of India. The parties irrevocable consent and submit to the person jurisdiction of court of Mumbai, Maharashtra, India.

The disputes if any relating to the purchase of product by the end consumer shall be resolved in accordance with laws of in India and shall be subject to the jurisdiction of the courts in Mumbai, Maharashtra, India.
